The concept of legal transplant, often depicted as a metaphor for the transfer of ideas and institutions from Western legal systems to other jurisdictions, is frequently justified by claims of increased efficiency, strengthened rule of law, enhanced human rights, and integration into the global order. However, the dissemination of Western ideas into other criminal justice systems is sometimes driven by a doctrine of dominance, disregarding the cultural contexts of the recipient countries. This issue is particularly evident in the Iranian legal system, where post-revolutionary policies have emphasized the Islamization of criminal institutions, leading to a skeptical stance toward the adoption of Western legal concepts. This study aims to examine the historical and contemporary instances of legal transplantation in Iran, utilizing library-based resources and a descriptive-analytical approach. It demonstrates how Iran's criminal justice system, through the selective adoption of foreign elements, has preserved its unique ideological and religious foundations, effectively shielding itself from further external influence by redefining the transplanted institutions.
