گستره‌یِ مسؤولیت کیفری اشخاص حقوقی، درحقوق ایران و اسکاتلند

چکیده

در پرتو مسؤولیت کیفری اشخاص حقوقی، تأمل بر چند مسأله حائز اهمیت می‌نماید : نخست آن‌که، بر پایه‌ی کدام شیوه یا شیوه‌ها می‌توان این مسؤولیت را به اشخاص مزبور که موجودهایی فاقد جسم و روح-اند، منتسب کرد؟ دوم آن‌که، گونه‌های جرایم قابل ارتکاب از سوی آن‌ها کدام، و به‌طور مشخص، از عهده‌ی جرایم نیازمند رکن روانی برخواهند آمد یا نه؟ در صورت مثبت بودن پاسخ، آیا اهلیت آن‌ها چندان است که قادر به ارتکاب جرایمی سنتی‌ای چون قتل عمد هم تلقی شوند؟ سوم آن‌که، با توجه به ماهیت خاصِ اشخاص حقوقی و با اهتمام به هدف‌های حقوق کیفری به‌ویژه پیامدگرایی، چه نوع ضمانت اجراهایی را می‌توان در مورد آن‌ها به موقع اجرا گذارد؟ چهارم آن‌که، آیا اثبات دفاع کوشش لازم از سوی اشخاص حقوقی در پیش‌گیری از جرم، می‌تواند موجبی برای گریز آن‌ها از مسؤولیت کیفری باشد؟ این نوشتار از رَه‌گذر بررسی تطبیقی نظام کیفری اسکاتلند به عنوان نظامی پیش‌گام در پذیرش مسؤولیت کیفری اشخاص حقوقی- متأثر از نظام کیفری انگلستان- و نظام کیفری ایران به عنوان نظامی متأخر در این وادی، به این دست از پرسش‌ها پاسخ خواهد داد. در برداشته‌های بحث نیز عبارت خواهد بود از ارائه‌ی طریق برای رفع کاستی‌های نظام کیفری ایران در این زمینه.

Scope of criminal liability of legal persons, in the Law of Iran and Scotland

چکیده [English]

Some issues are of great importance and noticeable in the realm of criminal liability of the legal entities. First, based on which method or methods the responsibility can be attributed to one who lacks the body and spirit? Second, which range of crimes can they commit? For example, are they eligible for crimes such as murder? Third, due to the specific nature of the legal entities and with respect to the objectives of the criminal law, especially consequentialism, what kind of sanctions can be applied to enforce them in a timely manner? Fourth, will the defense of due diligence by the legal entities in the prevention of the crime taken by the members suffice them to avoid from criminal responsibility? This article would compare criminal justice system in Scotland as a pioneer in the adoption of the criminal liability of the legal persons, under the influence of the criminal justice system of England, and the Iranian criminal justice system as a system, which adopted this liability later; and would answer to this kind of questions. Finally, after revealing the Iranian criminal justice system's shortcomings in this regard, solutions would be suggested to resolve them.
