موانع دسترسی زنان متهم به جرائم جنسی به عدالت در پرتو نظریة «مدونا-حور»

چکیده

یکی از نظریات در حوزة جرم‌شناسی زنان، نظریة مدونا-حور است. بر اساس آن، زنان در طول زندگی  نقش­های حساسی چون مادری و همسری را بر عهده می­گیرند. ارتکاب رفتارهای متضاد با این نقش­ها آن‌ها را از انجام وظایف اساسی خود باز داشته است؛ لذا شایسته نکوهش هستند. جرائم جنسی در تقابل با نقش­های اساسی زنان قرار دارد و زمانی که آنان متهم به این نوع جرائم می­شوند، نظام عدالت کیفری باید با شدت عمل برخورد ­کند. این مقاله با رویکردی تحلیلی‌توصیفی و انجام مصاحبه با زنان متهم به جرائم جنسی و مطالعة پرونده سعی دارد به برخی از موانع دسترسی زنان متهم به جرائم جنسی به عدالت در فرآیند دادرسی کیفری بپردازد. یافته­های تحقیق نشان می­دهد که نسبت به این زنان قرارهای تأمین کیفری سنگین­، در مقایسه با مردان، صادر می­شود و ظاهر و نوع پوشش و نحوة گفتار در توجه اتهام به آن‌ها نقش
پررنگی دارد. همچنین، در برخی از موارد زنانی که خود شاکی پروندة جنسی بودند، تحت تأثیر کلیشه­های جنسیتی، محکوم شده­اند.

چکیده [English]

One of the theories in the field of criminology of women is Madonna- whore. The basis of this theory is that women have an important role as a mother and a wife during their lives. Conducting a behavior contrary to the mentioned role will prevent them from doing their traditional roles. As a result, they are worthy of condemnation. Sexual crimes are in conflict with the fundamental role of women. Therefore, when they are accused of such crimes, they will be treated severely by the criminal justice system. This paper, using a descriptive- analytical method and by conducting interviews, tries to examine some of the obstacles of access to justice for women accused of sexual offenses in the criminal process. The results show that compared to men, women are confronted with more severe criminal warrants issued against them and their appearance, dress and manner of speech have an important role in this regard.
